Recruit sues CPD academy for discrimination

The Slum Times posted a story about a Police Department recruit who is suing the city for discrimination because he was fired for disobeying a direct order from ADS Matthew Tobias after Tobias allegedly used racially charged remarks about the recruit's polish background.

The suit claims Tobias asked Palka, "What the fuck are you thinking? You didn't read the Firearm Manual?" Palka says he responded that he had read it, but not recently.
Tobias then asked Palka about his nationality, the suit claims. When Palka told him he was Polish, Tobias allegedly said, "You look terrible. We don't need people like you. Get the hell out of my
office."


I'm sure we're only getting half the story here. The department is in desperate need for bodies and to kick one out over some range dispute seems like a large part of the story has been omitted. Dora, an awarding-winning competitive shooter and range instructor, is a sincere sweetheart and bends over backwards to help her students. For her to have a dispute with a recruit reflects poorly on the recruit - not on her.



On the other hand, the staff at the academy knows that it can only criticize white male recruits - all others are "hands off". When I went through I remember plenty of people that couldn't keep up on the long distance runs. They'd routinely disappear and then magically "reappear" a few minutes after the main group got back. If any of those dog-asses had been white they would have been written up and shown the proverbial door.

So good for this kid for speaking up and taking a stand. At least the department will have to face up to the fact that "equality" is not all equal when it comes to training standards. I'd love to know how many recruits over the last 10 years have been pushed through their training cycles because they had a phone call or out of political correctness. I personally know a few that should never have made it through their probationary period.

If he doesn't know proper weapons usage do you really want him running around armed? Or maybe he not understand english?

Rosco - are you even the Police??? I'm starting to think you're just some annoying troll who just wants to type the first thing that comes to mind.

To answer your question, I'd say that about 1/3 of any class is firearms deficient. It's the task of the Range instructors to get the recruits properly trained. It can be done and it is all the time.

Hell a kid next to me consistently hit the ceiling and metal target stand every time he shot. But he hung in there, got extra practice and became a mediocre shot. I just saw him recently and he's never been in a gunfight but continues to train regularly.

Now if this recruit has a negative attitude and is a trouble-maker, let him go. By all means. But if they're just picking on him because he's polish (which I find hard to believe, honestly!) then he's got a case. In the academy you've gotta suck it up and play the game, by their rules. That's the way it's always been and that's what you have to do to make it through.

QUALIFICATIONS OF AN OFFICER AND IF THEY ARE A AWARD WINNING PERSON DOES NOT MEAN THEY ARE A GOOD INSTRUCTOR. AN INSTRUCTOR IS MEANT TO TEACH THE RECRUIT AND NOT TO PUT THEM DOWN. THE STATE POLICE ASSIGNS A PERSONAL INSTRUCTOR TO HELP ON ANY PROBLEMS THE RECRUIT HAS. AND FOR ROSCO MAYBE THE PERSON WAS GETTING TREATED UNFAIRLY AND WAS GOING TO FAIL NO MATTER WHAT HE DID. AND FOR THE RECORD I EVEN THINK HE WAS FORMER LAW ENFORCEMENT. BUT IT LOOKS LIKE YOU WORK THERE AND TRYING TO DEFEND A LOST CAUSE. WHEN PEOPLE MAKE MISTAKES THEY NEED TO THINK WHAT CONSEQUENCES MIGHT OCCUR. WELL IM HAPPY SOMEBODY STEPPED UP AND FOUGHT THE UNFAIR PRACTICES OF THE POLICE ACADEMY.

Look what I found! That ADS must not like polish people!
Chicago (PMN Exclusive Report)—Wojciech Czarniecki was summarily dismissed from police recruit training, but is fighting back to regain his position and protect his honor. The law firm of Avila and Zurla is representing him and, as a first step, on June 28, 2007, wrote to Chicago’s Police Superintendent, Philip J. Cline, asking him to review the matter and correct what they describe as a serious error.


According to David A. Miley, an attorney with Avila and Zurla’s office, "Czarniecki was an exemplary recruit for his ten weeks at the Timothy J. O'Connor Police Education and Training Center. Throughout his training, Mr. Czarniecki scored at or near the top of his class in all subject areas."


Approximately nine weeks into the training, another recruit of Polish ethnicity was dismissed for lying about study materials when questioned. Then another recruit in Czarniecki’s class, Samuel B. Rawls, alleged that Czarniecki possessed an unauthorized copy of an examination. Czarniecki was questioned about the matter and instructed not to tell his classmates that he was under investigation for having unauthorized study material. When Czarniecki’s classmates noticed deviations from his customary schedule while being questioned, and heard rumors that Czarniecki was under investigation, those classmates hounded him for information. Czarniecki, true to his instructions not to discuss the nature of the accusations, told them simply, "I may be in trouble," and refused to speak further on the matter.


The academy’s investigators determined that Czarniecki possessed only authorized study guides and no examinations, and he was cleared of all charges. In effect, Rawls’ accusations were found to be without merit.


Attorney Miley claims that, despite the fact that Czarniecki was cleared of all charges, he was summarily dismissed by Assistant Deputy Superintendent Matthew Tobias, without investigation or questioning, purportedly for violating orders not to tell his classmates that he was under investigation.


The letter to Cline stated: "The remarkably close temporal proximity between the dismissals of two of the only Polish recruits lends credence to the reported speculation that ADS Tobias may hold a prejudice against Polish recruits."


In the event that corrective action is not taken by the Chicago Police Department, the attorneys suggested that legal action was possible against Rawls and the City of Chicago.


Czarniecki was born in Bialystok, Poland, and was naturalized as a U.S. citizen in 2001. He attended Chicago Public Schools, graduating from Lane Technical High School. He received a bachelor’s degree in Criminal Justice from the University of Illinois at Chicago, where he was on the honor roll and received academic scholarships. While studying at UIC, he minored in Polish. He is fluent in English, Polish, and Spanish, and is functional in several other Slavic languages. He worked his way through school as a lifeguard with the Chicago Park District, where he was promoted to managerial lifeguard, supervising thirty lifeguards at the age of only 21 years, and coached a high school swim team.

he is going to win! you get fired for a stupid manual and he got ratted on thats not cool whatever there is no more brotherhood in the police department. the police academy is like like high school everybody tells on each other not realizing they get the whole class introuble because they are trying to better themself. instead it looks like you need to be a minority to get a break. Being polish is not a minority but a national orgin and that is covered under the law. it looks like the supervisor did not look at the the repercutions that might happen when he fired 2 polish recruits because supervisor that have excempt positions think they are excempt from the law and to me that is not right. supervisors should have your back not trying to favor people because they are minority or they got juice but it takes people to open there mouths.

all the people that make these comments are minorities, and females that you really want coming when u call for a 10-1! in 9 we got a female that needs a step stool for a traffic stop or could take somebody down at the pre school . i cant wait till somebody good gets hurt so the dept realizes what idiots they hire.

good for the kid looks like hes being hammered unnessicarily over silly shit, when i came on and was sent to 007 guy who trained me total of 3 days said lets see the manuals and all written stuff they gave you at Obrien st. he took it and tossed it in garbage can in back of station, now you are going to learn the real world following week i was 99 on days like i said real siiy stuff for a kid to lose job over

how can they pick on a Polish kid when the most inept basteards with attitudes on this job are one step from a thatched roof house and potatoe field in Ireland there was a Mick name tony barry who was lucky he knew how to tie his shoes and they made him a sgt in IAD and you dont know half of stuff he pulled unbeleibale

If the kid had more pull then he would be on the streets by now. I find it strange that two polish recruits both get fired in the same week.

Perhaps if the kids played hockey, they'd still be coppers. Note to self, sign my teenage daugther for hockey.
